Illinois AI law

Illinois AI law is
already here.

Illinois moved faster than most states on AI in the workplace, and the rules already reach Chicago employers. Three are on the books:

  • The Human Rights Act AI amendment (HB 3773), effective January 1, 2026. Employers may not use AI that produces a discriminatory effect in employment decisions, may not use ZIP code as a proxy for a protected class, and must tell workers and applicants when AI is used in those decisions.
  • The AI Video Interview Act, law since 2020. If you use AI to analyze video interviews, you have to tell applicants, explain how the AI works, and get their consent first.
  • The Biometric Information Privacy Act (BIPA). Any tool that reads faces or voices needs written notice and consent, and Illinois residents can sue over violations.
